The costs
With regard to Italy, the Italian Episcopal Conference periodically emits a decree (the one currently in force is the CEI Decree 68/07 of 30.01.2007) which results in a tariff for lawyers. There is a fixed court fee (€ 500.00) and a fixed fee for lawyers. We start from a base fee of € 1,500.00 to a maximum fee of € 2,850.00, net of taxes and contributions for the Cassa Forense, with the premise that the maximum fee shall be authorized in writing by the Judge, in case of particularly difficult legal cases or for the need of special inquiries.
If the negative results of the proceedings at first instance should prove necessary an appeal, this will lead to an increase of € 575, increasing to € 1,150,00 with the written authorization of the Judge.
Obviously, cases before the Roman Rota, given the nature of the Court and the special preparation needed to sponsor before it, require a separate fee, but it is worth specifying that the appeal to the Roman Rota rarely becomes necessary, and that it is nonetheless forbidden to ask unbalanced unfees.
It is also worth mentioning that it is possible for those with less economic possibilities, to be admitted to a forms of legal aid or to have an almost free admittance even before the Roman Rota.
These arguments seem therefore to prove that not only crowned heads can be admitted before the courts of the Church.
